What's New Form 1120-ND may now be filed electronically or by pen and ink. It is filed electronically if the following are met: The filer elects to use a Form 1120-A or 1120-S electronically. The filer elects to use the paper application. For Form 1120-A filing, the filer elects to use either “paperless” or “electronic filing.” If filing electronically, the filer: Must elect paperless filing (i.e., electronically file if the filing is made electronically) when filing Form 1124 and prior returns if he or she files electronic returns with Form 1120-A or 1120-S. This includes tax years 2022 and 2010. May elect electronic filing, without filing, when filing any subsequent return unless an electronic return is also filed. May now electronically file a return if he or she makes any required filing information available electronically to his or her employer (at least by Internet) and is not required to file electronically. May electronically file any return if the filing is done for an employer, in which case the filer is required to have the return filed electronically. If filing electronically, the filer may make any changes to the form prior to filing in place. May electronically file for refund if the filer files electronically (either electronically or with paper) and files a paper return, even if the filer cannot change anything in the return. For Form 1120-S preparation, the filer elects to use electronic transmission of return information. Filing Requirements The electronic filing requirement is a tax information return. You are required to file an electronic return, and you must file the return electronically. The filing is done by using a computer to: Prepare forms for you and your employees (in case of an employee who does not file electronically). File a return that indicates filing intent. To get credit for filing the return electronically, you must file the returns or pay the tax, or both, in the specified time period for electronic returns. Form 1120-ND helps reduce the risk of a taxpayer claiming the earned income credit, the additional child tax credit (at the same time that a taxpayer is claiming the Additional Child Tax Credit; see question 7), and/or the American opportunity tax credit.
