FAQ - Form 1120-ND

What is the purpose of Form 1120-ND?
Form 1120-ND helps reduce the risk of a taxpayer claiming the earned income credit, the additional child tax credit (at the same time that a taxpayer is claiming the Additional Child Tax Credit; see question 7), and/or the American opportunity tax credit. To see whether your Form 1310, the Form 1120-ND, and the Form 1040 form to be used for the earned income credit, the additional child tax credit and/or the American opportunity tax credit must be dated within the most recent 12 months. The taxpayer doesn't need to be sure of the dates of the different forms; use Form to search current and prior year filings. For help filing the American opportunity tax credit, click here. Are certain credits or deductions counted for purposes of the earned income credit, the additional child tax credit, and/or the American opportunity tax credit? Certain credits aren't counted: A deduction for medical expenses paid in the previous year. A deduction paid by the taxpayer for a qualified tuition program (see Q&A 19). A deduction paid by the taxpayer for a qualified employer plan. A deduction paid by the taxpayer for personal exemptions. A deduction paid by the taxpayer for contributions to a governmental or religious retirement plan. A deduction for qualified charitable contributions. A deduction paid to an employee organization for services to be performed by the organization on behalf of the employer. If a taxpayer isn't making the maximum allowed deductible contribution to a governmental or religious retirement plan, contributions that are allowed to be deducted for tax purposes may be deducted from the earned income credit for 2017 using Form 8959, Contributions Made in the Current Year and in the Prior 12 Months, or Form 8958, Contribution to Governmental or Religious Retirement Plan for Tax Year 2, and Form 8959A, Contributions Made in the Current and Prior to 12 Months; see Form 8959, Contributions Made in the Current Year and in the Prior 12 Months, and Form 8958, Contribution to Governmental or Religious Retirement Plan for Tax Year 2, for more information.
